Overview
The eServices register will move to a new contract on 1 July 2025.
The new contract combines the previous eServices and IT infrastructure contracts into a single contracting framework.
Prior to making this change, we consulted with many buyers and suppliers and found that the existing eServices contracts no longer met the needs of a changing technology landscape or the way government now procures IT goods and services.
We’ve improved the contract in response to buyer and supplier feedback. Engagement with businesses will be easier, thanks to simplified contracting terms and flexible terms for software. Buyers will also have a choice between a Short and Long Form Contract.
All procurements released to market after 1 July 2025 will use the new contract.
The new contract documents are below.
The benefits of the new contract are:
- The contract is easier to read, and features simplified and standardised terms and conditions.
- The contract now covers software licenses and provides flexibility to include suppliers’ end user licensing agreements (EULA).
- The IT product scope has been extended to include all information and communication technology hardware.
- New GenAI and probity provisions have been included.
- Agile methodology is now supported.
- The contract has been reviewed and certified under the Unfair Contract Terms scheme.
The new contract documents include:
- The Deed of Registration, which suppliers will need to sign to confirm eServices register membership.
- The Short Form Contract, which is appropriate for low risk and/or low complexity procurements under the value of $1 million. This is shorter and simpler to use.
- The Long Form Contract, which is appropriate for high risk and/or complex procurements over the value of $1 million. This contains additional protections for projects that are higher risk
- The eServices Schedules, which cover the ICT goods and services scope of the eServices register.
- A new, easy-to-use ordering document to replace the contract variable document.
Information for suppliers
The new contract will make it easier for suppliers to work with the Victorian Government.
Existing eServices suppliers need to sign and return the Deed of Registration for processing by 23 June 2025 to support the release of the contract and remain on the eServices register after 1 July 2025.
New eServices suppliers need to follow the eServices registration process in Digital Marketplace and confirm acceptance of the current eServices contract. This will allow them to be invited to RFQs released before 1 July 2025. New suppliers will also need to sign and return the Deed of Registration by 23 June 2025 to continue their eServices membership.
We are holding 2 online information sessions for suppliers to provide more information on the new contract. All suppliers are encouraged to register. Both sessions will be the same, so suppliers only need to register for one.
How to sign and return the Deed of Registration
1. Download the suite of eServices contract documents above.
2. Arrange for the Deed to be signed by the company’s authorised representative.
- Companies who have 2 or more directors must have their Deed signed by 2 directors, or 1 director and a company secretary.
- Companies who have one director must have their Deed signed by the director.
- Sole traders must sign the Deed themselves and include a witness signature.
3. Email the signed Deed to support@buyingfor.vic.gov.au.

Suppliers are also reminded to keep their Fair Job Code pre-assessment certificate and insurance certificates current at all times. An expired certificate can lead to a missed RFQ opportunity.
A signing period of 4 weeks is provided to allow suppliers ample time to review the new contract and sign the Deed. Suppliers who do not return their signed Deed by 23 June 2025 will be removed from the eServices register. To re-join is simple. Log into Supplier Hub and follow the standard eServices register application process.
Information for buyers
This contract update represents a major improvement for buyers.
Buyers should familiarise themselves with the new contracts and read the fact sheets below.
Suppliers have been asked to sign a Deed of Registration, which confirms their agreement to supply under the new eServices Contract terms.
All suppliers must agree to be engaged under the Short Form Contract terms. Agreeing to the Long Form contract terms is optional, but encouraged so they do not miss out on RFQ opportunities.
Buyers should encourage suppliers that they work with to complete these steps.
Using the new contract
All procurements released before 1 July should use the existing contract and can continue until the procurement activity is completed.
All new procurement from 1 July 2025 will use the new eServices contract. For each eServices RFQ, buyers will need to specify whether the Short or Long Form Contract will be used.
Buyers who want to use the Long Form contract for their activity should check whether their preferred suppliers have agreed to be engaged under these terms. The signed deed can be viewed in each supplier’s profile, and will state which terms they have agreed to.
